A “ historic advance » for all people who have had a health problem who wish to take out a mortgage but who are prevented from doing so by the drastic conditions of the borrower’s insurance? In the future, no medical questionnaire will be required to take out insurance for loans below 200,000 euros. Deputies and senators, meeting in a mixed joint committee (CMP), agreed, with the support of the majority but against the opinion of the government, on this measure on February 3, 2022 within the framework of a bill supported by the deputy Patricia Lemoine (Agir ensemble, Seine-et-Marne) which aims, overall “ fairer, simpler and more transparent access to the borrower insurance market”. Its conclusions were unanimously approved on February 10 by the National Assembly and then on February 17 by the Senate.

For a loan repaid before age 60

But beware, this measure assumes certain conditions, in particular “be under 60 years old “. And, here again, vigilance because many media suggest that this is the age limit when “subscribing” to insurance; in reality, the credit must have been “repaid” before this age. This implies being under 35 when taking out a 25-year loan or 40 years for a 20-year loan. Could things change in the future? LThe entry into force of this measure is set for June 1, 2022 in order to give professionals time to adapt. A review must be carried out in two years, with the possibility for the government to change both the ceiling of the amounts and the age, according to the cabinet of the deputy.

AERAS convention to review!

For amounts over 200,000 euros, the medical questionnaire remains in force. People who have difficulty taking out insurance because of a health problem can apply via AERAS (Assure and Borrow with an Aggravated Health Risk). However, the restrictive conditions of this agreement ultimately allow few patients to benefit from it, deplores Vaincre la mucoviscidose. The next step, provided for in the bill, requires its signatories to enter into negotiations in order to make this system more flexible, in particular by sagreeing to an increase in the ceiling of the loan amount that can be subscribed, currently set at 320,000 euros.

Right to be forgotten from 10 to 5 years

Another important measure concerns the “right to be forgotten”, which now allows former patients with two serious pathologies (cancer or hepatitis C) to no longer have to declare them to their insurer ten years after the end of their therapeutic protocol for adults and five years later for patients diagnosed until they are 21 years old. With this new text, the period increases to five years for everyone, regardless of age, as Emmanuel Macron committed to during his 2017 campaign. crucial for the personal reconstruction of patients in remission”, welcomes the LREM group in a press release. And for the others? The negotiations with the AERAS partners mentioned above should also make it possible to discuss an extension to a greater number of pathologies. In the absence of progress between the actors, the government will have the possibility of taking measures by decree in Council of State, no later than July 31, 2022.

Other measures for all

Other measures, open to all, appear in the text adopted in CPM, such as the possibility of terminating one’s borrower insurance contract. In the future, all French borrowers will be able to get rid of their “real estate” loan insurance by playing the competition and thus recovering some purchasing power. For the moment, households can only change it during the first year of subscription and on each anniversary date of the contract. They will soon be able to do so whenever they wish. This new provision must come into force from June 1, 2022 for new contracts and from September 1 for those already signed. Finally, this text strengthens consumer information on their rights and increases the penalties for banks and insurance companies that do not play the game.

The bill must now be definitively validated by the National Assembly on February 10 and by the Senate on February 17. As long as he has the support of the government, the LREM and LR majority, this should not be a problem. It will then be necessary to wait for its promulgation in the Official Journal.
